ASSUMPTION OF RISKS


I will be involved, either as a participant or as a volunteer in various activities and programs sponsored by the Josh Minton Foundation (“JMF”), to be conducted on property owned or leased by JMF. By such participation in such activities and programs, use of ATV or other vehicles and all other issues related to severe weather (“Activities”), I acknowledge that I am voluntarily exposing myself to various risks and dangers, whether foreseen or unforeseen. I am fully aware of these risks, and assume and take full responsibility for such risks and for any injuries or losses that may result from such participation in such Activities.

I further acknowledge that contact with others during the current COVID-19 pandemic involves a certain degree of risk that could result in illness or even death; that the COVID-19 virus has a long incubation period during which carriers of the virus may not show symptoms and still be highly contagious; and that it is impossible to determine who has COVID-19 and who does not given the current limits in virus testing. I understand that participating in the Activities and having personal contact with volunteers and others involves a certain degree of risk, namely of acquiring COVID-19, and then possibly passing it on to others, including family members. I agree that, if I have underlying health concerns which may place me at greater risk of contracting COVID-19, I will consult with a health care professional before coming on the JMF premises or otherwise participating in any such Activities.

WAIVER OF LIABILITY; INDEMNIFICATION


I (and my heirs, executors or representatives) hereby release and indemnify JMF and its directors, officers, employees and volunteers from and against any liability (including attorney fees and costs) for personal injury, death, property loss, or other damage suffered or sustained by me in connection with or arising out of participation in JMF Activities, including any transportation to or from JMF’s programs or activities.

We, the parents or legal guardians of the above-named Minor, consent to the Minor’s participating in various activities and programs sponsored by the Josh Minton Foundation (“JMF”) to be conducted on property owned or leased by the JMF.
